Why is the ‘emergency’ and the period around it known as the period of constitutional crisis? Explain.

Answer :

Emergency is the situation of law and order, when the security and stability of the country is threatened by internal and external threats. There can be three types of emergency imposed:

a) When there is a war or external aggression has been committed or there is threat of the same, or if internal disturbances amounting to armed rebellion taking place.


b) When it becomes impossible for the government of a State to be carried on in accordance with the Constitution.


c) If the credit or financial stability of the country is threatened.


The Emergency and the period around it can be described as the period of constitutional crises because it had its origins in the constitutional battle over the jurisdiction of the Parliament and the judiciary.
